What's interesting is Raja discussed lots of interesting things in the entire interview. From how he was groomed by GKV, his experience of working with Kavignar to how he used to prepare singers and musicians for recording. But somebody needed to get their fifteen minutes of fame and so the entire interview was reduced to one controversial talking point. Very Happy

Where, it seems he didn't even make a direct reference to 96. Onnum solalenaalum, "illa, sonna naanga offend aarom" na vandhuduvanga.

Sure he does. But so does Vairamuthu or any other lyricist (including Gangai). Let us see whether they now stake their claims given that the Court has upheld the principle. IR cannot claim lyricists only worked at his behest (like singers or musicians in his troupe). They are also co-authors of creative content in every song he has composed, except for the few where he penned the lyrics himself where he will enjoy total copyright.

Per one news report, I believe IR's side argued that they are doing what other MD's (read ARR) are doing, though claiming it very late in the game.

So, even though we hear IR talking "I have ALL the rights" in some interviews, I guess he means only what ROYALTY rights a composer typically has on his compositions (which may be 1/4th of royalty - with another 1/4th to lyricist and 1/2 to music producer. It's possible that he registered his 80's / 90's songs in such a way that he was the music producer also - while the producer of the movie had only theatrical rights / license to exhibit - and thus giving IR 75% royalty).

In any case, Echo (and such labels) made millions when his music was ruling the charts and should have no reason to complain the pittance that will come as royalty at this time, with not much media getting sold. Unless they have other ulterior business initiatives (such as licensing these songs to be used as ringtones, streaming on internet, BGM of TV shows, new movies etc) which have potential to rake in millions even now.

Enjoyed listening to the first interview link. Raja showed more of his human side especially when he was recounting his formative years as MD, his candid admission of not knowing swaras/notes, his determination to master them so that he could be on dictating terms w.r.t to the fellow musicians, his initial struggle with bgm scores and his innovative approach which made him surpass his competitors in bgm department, all of these make him so endearing. We are so used to his philosophical, sagely facet that this one is refreshing indeed. Smile

Summary of Conclusions

The Court’s conclusions, in view of the facts and the law cited above can be summed up thus:

A music composer’s copyright is over his musical work, whereas a film producer is entitled to rights over sound recordings in the film, unless the music producer reserves his right to the sound recording.

A music producer is entitled to special, moral rights in regard to the ‘musical works’ composed by him upon which the ‘sound recordings’ in question are based, in line with Section 57 of the Copyright Act.

Ilaiyaraja’s special rights entitle him to claim authorship of his work, take all measures necessary to preserve the integrity and purity of his work, honour and reputation and exploit such ‘musical works’ in any manner as he may desire, only barring in the form of the connected sound recordings that are an integral part of the cinematograph films, for which copyright is held by the respective producers of the films.

Echo Recordings has obtained rights in regard to the ‘sound recordings’ comprised in the films covered under their agreements with film producers. Echo is entitled to exploit the same, specifically and strictly in the form and manner as contained in the respective cinematograph films only.

The case brought by Agi was dismissed in view of the expiration of their agreements concerning the use of Ilaiyaraja’s music.
